    The Ministry of Economy canceled the NOM 236 verification for light cars that would come into force on December 1, 2022.The NOM 236 verification has been annulled, members of the Ministry of Economy reported that this regulation was officially canceled as of November 4 of this year, which it forced the owners of light cars to carry out a physical-mechanical verification.

    The NOM 236 standard or verification had been scheduled to enter into force on December 1, 2022, however, through an official statement, the National Commission for Quality Infrastructure of the Ministry of Economy announced its cancellation, arguing that “It could negatively affect the income of Mexican families who use their vehicles as a work tool.”

    With the cancellation of NOM 236, the income of families that have a car mainly for work, domestic use and as a tool for them would now benefit. It should be noted that the regulation was published in May 2022 in the Official Gazette of the Federation (DOF) where it was established that the measure would enter into force on December 1, 2022.

    WHAT WAS NOM 236?

    NOM 236 stated that owners with a car weighing less than 3.8 tons would be required to undergo an extra check under the following conditions:

    • Vehicles private transport: four years after the date of its sale as a new vehicle, and from then on, every two years until the ninth year.
    • Private transport vehicles 10 or more years after the date of their sale as a new vehicle: every year.
    • Intensive use vehicles: one year after the date of sale as a new vehicle; and every year thereafter.

    What does the NON 236 check mean and what is removed?

    The Official Mexican Standard (NOM) 236 stated in its regulations that it would be mandatory for all owners with a car less than 3.8 tons to carry out a physical-mechanical verification to be able to circulate in any of the 32 entities of the Mexican Republic; Likewise, all private motor vehicles would have to carry it out after the fourth year of circulation.

    The criteria that would be reviewed by car owners with the aforementioned characteristics would be:

    • Body and chassis
    • doors and chest
    • windshield and windows
    • Windshield wipers and washers
    • Auxiliary tire support
    • Seats and anchors
    • Seat belts
    • Speedometer
    • Horn
    • Lightning
    • Braking system
    • Direction system
    • Engine
    • Suspension and transmission system

    It was a new form of verification. In May 2022, the authorities of the Ministry of Economy of the Government of Mexico announced in the Official Journal of the Federation —at the beginning of May 2022— the Mexican Official Standard 236.

    Despite the economic implication that this can bring to the pockets of Mexicans, this initiative has several positive purposes, including the regulation of cars imported into the country, also known as “chocolate cars.”

    NOM 236 indicates that vehicles for private use must be subjected to a physical-mechanical inspection, with the aim of guaranteeing optimal safety conditions during the circulation of drivers.

    This practice has been implemented throughout Europe and more than 10 countries in Latin America, Asia and Africa, which among other purposes, seeks to reduce the rate of vehicle accidents associated with mechanical failures.

    According to data from the National Institute of Statistics and Geography (INEGI), in 2020, 3,155 accidents due to vehicle failures were recorded in Mexico.

    For its part, the World Health Organization He mentioned that these figures have significant economic and social repercussions at a global level, including an approximate cost of 3% of the GDP of each country and the loss of 1.3 million lives.

    With the NOM 236 A decrease in the mortality rate associated with vehicular accidents is expected, as part of the commitment made worldwide to reduce deaths by up to 50% between 2020 and 2030 —an initiative stipulated during the Stockholm Declaration in the Framework of the Third Conference World Ministerial on Road Safety.

Vehicles with minor defects may be temporarily circulated and must be repaired as soon as possible; while vehicles classified as serious will be kept out of circulation until they are repaired.
