The Senate of the Republic settled this Thursday a long-standing demand of the workers by unanimously approving by 89 votes, extending from six to 12 days minimum the number of days of holidays paid from the first working year for workers hired individually or collectively. Update on the Federal Labor Law
The opinion, coming from the Labor and Welfare Commission and the Legislative Studies Commission, Second, establishes that as of the sixth year, the vacation period will increase two days for every five years of service until reaching 30 days off, and from there until reaching 32 mandatory days off for 35 years of service.
Update in the Federal Labor Law to increase vacation days
The senator Napoleon Gomez Urrutia, president of the Labor Commission and Social Security, explained that articles 76 and 78 of the Federal Labor Law are reformed. The document mentions that this project has the objective of shielding the human right to vacations, without putting at risk the operability of companies or work centers.
It is necessary to put a stop to this abusive scheme that takes advantage of a virtuous cultural practice, to turn it into a way of stripping people of the minimum elements of a dignified life as is the right rest.
Adaptation to the Federal Labor Law
These long days, the senator added, are added to the limited days of vacation that the Labor Law recognizes as a right and pointed out that currently they are only granted 6 days of vacation paid after the first year of work, which represents a very low number compared to the situation in other Latin American countries and the rest of the world.
This is the case in Peru, Cuba, Nicaragua and Brazil, where workers have the right to 30 days of vacation paid. In Russia, a worker is entitled to 28 working days of paid vacation; or, in Spain with 22 days of paid vacation….
It is worrying that Mexico is at the bottom of the list as the only one that contemplates less than 10 days of vacation paid for their workers. This feature is one of the many reasons why the International Labor Organization gives Mexico a low rating on labor rights.
Adaptation to the Federal Labor Law
Like Gómez Urrutia, the other parliamentary groups agreed that not granting adequate rest and recreation time translates into health damage with effects such as decreased effectiveness and job continuity.
Decent vacations are a worker’s right
Raphael Thorn de la Peña, president of the Second Legislative Studies Commission, stressed that this is one of the pending reforms for the benefit of the country’s workers, because “the right to vacations and recreation raises productivity and makes us more competitive”.
Patricia Mercado, from MC, acknowledged that this reform is a triumph of the workers and the workers who have made themselves heard. PAN member Víctor Fuentes received applause and recognition from Morena and his allies because he assured that this reform would never have happened in times of Fox, Calderon either Grief.
According to data from the Mexican Institute of Social Security, 75% of Mexicans seem fatigue by stress labor (burnout at work), surpassing countries like China, the United States and many more, which directly affects the results they give in their jobs.
